New Jersey State not bound by IRS APAs

The US State of New Jersey says it is not bound by advance pricing agreements (APA) with the IRS.

In a June 6 technical advisory memorandum (TAM), the New Jersey Division of Taxation’s regulatory service said that while it will “take into consideration” APAs between taxpayers and the IRS, ultimately it may use other factors to establish a “fair and reasonable tax”.
