New regulatory and tax environment for Chinese representative offices

Representative offices (RO) and other foreign employees, who split their salary payments between China and their home country, may need to comply with China’s transfer pricing regulations for the 2010 audit period.

The requirement, issued by the state council, follows the Provisional Regulations on Taxation of Foreign Representative Offices, Guoshuifa [2010] No.18 (Circular 18), which took effect on January 1 2010.
