An Indian court has outlined the three criteria that taxpayers must satisfy to constitute a fixed place permanent establishment.
The Mumbai Income Tax Appellate Tribunal held that the existence of a physical location, the right to use that place and the performing of business through that place must be demonstrated before a permanent establishment (PE) can be established.
