Exclusive: Update: Court orders IRS response to Xilinx

Xilinx has filed for a rehearing or a hearing en banc in the latest development in this historic case.
Judge Raymond Fisher of the Court of Appeals for the Ninth Circuit has directed the Internal Revenue Service to file a response to Xilinx's move.
Xilinx, the world's largest supplier of programmable logic devices, has been embroiled in a battle with the Internal Revenue Service over transfer pricing. The case concerns the inclusion of stock-based compensation in the charges of a cost sharing agreement and has been hailed as the most significant transfer pricing case in the US in 20 years and even internationally, as practitioners believe the case has implications for tax treaties the US has negotiated with other countries.
