Commissioner Shulman gloats over Xilinx win

Speaking of the controversial IRS win in the US Court of Appeals for the Ninth Circuit in the Xilinx case, IRS commissioner Douglas Shulman called the decision a “real victory”.
The case looked at the inclusion of stock-based compensation in the charges of a cost sharing agreement and has caused a stir among the tax community as the government won the appeal, though the court did not agree with the IRS’ arguments.
